Getsports Enterprises, LLC. operates the Zoomtown Hoops Challenge online service. As with any online service, we must establish some basic rules designed to ensure enjoyment by all our Users.

The ZoomTown Hoops Challenge User Agreement sets forth the terms and conditions of your ZoomTown Hoops Challenge registration. As a condition of registration, you must accept the agreement in its entirety; therefore, we encourage you to carefully review and familiarize yourself with it. In addition, you should review the agreement from time to time for any important changes. The current version of the ZoomTown Hoops Challenge Terms of Service will always be available online via the "Terms of Service" link at the bottom of every ZoomTown Hoops Challenge page.

General: "ZoomTown Hoops Challenge" is an interactive online service (the "Service") on the World Wide Web of the Internet (address: http://www.ZoomTown Hoops Challenge) operated by Getsports Enterprises, LLC. ("ZoomTown Hoops Challenge"). The Service offers users (as hereinafter defined) access to (i) information, software and other content owned or licensed by ZoomTown Hoops Challenge and third-parties ("Content Providers"), and (ii) merchandise and services offered by ZoomTown Hoops Challenge and independent merchants ("Merchants"). "User" means any person who establishes an authorized account ("Account") for access to and use of the Service. The right to use the Service is personal to the user and a User's Account is not transferable. Unless authorized by ZoomTown Hoops Challenge, a User must be an individual who is at least thirteen (13) years of age and may not be a firm, business entity or institution. A User may permit usage of the Service by other individuals in User's household, but the User remains solely responsible for all charges incurred by such individuals. By registering as a User and using the Service, you accept and agree to comply with the this Agreement, as modified from time to time ("Agreement"), and all rules or policies posted on the Service ("Operating Rules"), for as long as you remain a User. Except as expressly permitted in this Agreement or the Operating Rules, no portion of the Service (including any information, content or software other than software to be used solely in connection with User's Account) may be downloaded, reproduced, redistributed, retransmitted, published, resold or otherwise commercially exploited by any User.

Changes: GetSports Enterprises LLC reserves the right, at any time, to (i) change the terms of this Agreement or any Operating Rules, (ii) change the Service, including eliminating or discontinuing any content or feature of the Service, restricting the hours of availability or limiting the amount of use permitted by the User, or (iii) change any fees or charges for use of the Service, including instituting new or increased fees or charges for the use of the Service or any feature thereof. Users will be given a minimum of thirty (30) days notice prior to any increase in existing fees or charges becoming effective. All other changes shall be effective immediately upon notice. Any use of the Service under a User's Account after such notice shall be deemed to constitute acceptance by the User of the changes.

Indemnification: The User agrees to defend, indemnify and hold harmless ZoomTown Hoops Challenge, its affiliates and Content Providers and their respective directors, officers, employees and agents from and against all claims and expenses, including reasonable attorneys' fees, arising out of the User's use of the Service or the User's Account.

Game of skill: The games on our site are games of skill in which participants use their knowledge and analysis of the sport in question and the manner in which players manage their respective teams. Winners are determined by objective criteria under the “Rules” section of each game (attached). The ultimate goal of these contests is to compete in a fun-filled, interactive environment and enhance your enjoyment of sports.

Participants: By entering in our contest, players acknowledge that they have read and agree to abide by the official rules and regulations governing the game(s).

Fully interactive site: We have setup a fully interactive web site that allows authorized users to manage their teams via the internet by accessing our site www.ZoomTown Hoops Challenge. Players will be able to track their performance and manage their team while on the web site.

Content: Much of the content posted our site is original content, but does not necessarily express the opinions of GetSports Enterprises, LLC. ZoomTown Hoops Challenge contains copyrighted material, and the entire contents of the Service are copyrighted as a collective work under the United States copyright laws. Except as expressly permitted by this Agreement or the Operating Rules, the User may not copy, reproduce, publish, retransmit or redistribute copyrighted materials, in whole or in part, in any manner, without the express written permission of the copyright owner. The User may download or make a single copy of copyrighted materials solely for the User's own personal use, provided the User preserves any copyright or other notices contained in or associated with them. ZoomTown Hoops Challenge shall not be responsible for any opinions, views, advice or statements posted on the Service (including, without limitation, in any public posting areas of the Service) by any person or entity other than an authorized ZoomTown Hoops Challenge or GetSports spokesperson. Service advertisers, Content Providers, User, guests, independent writers and experts are not authorized ZoomTown Hoops Challenge or GetSports spokespersons. At no time should the opinions, views, advice or statements provided by Service advertisers, Content Providers, User, guests, independent writers or experts be relied upon for important personal decisions without independent verification. Except as stated in the license agreement accompanying any software provided through or in connection with the Service, the User is granted only a personal, nonexclusive and nontransferable license to use such software, and unauthorized copying of software is prohibited.

Internet/Technology Problems: If for any reason ZoomTown Hoops Challenge or any of our third party software is not capable as planned, because of, but not limited to, an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of ZoomTown Hoops Challenge which corrupt or affect the administration, security, fairness, integrity or proper conduct of our games, then we reserve the right to modify rules or suspend the game. We assume no responsibility for any error, omissions, interruption, deletion, defect of delay in operation with transmission, communication, line failure, theft, destruction, or unauthorized access to our game and/or web site and/or software.

Participant Proprietary Information: Any proprietary information given to the principal participants, including but not limited to an internet password to access ZoomTown Hoops Challenge or its games, shall be kept confidential by both ZoomTown Hoops Challenge and any participant.

Event Tampering: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDREMINE THE LEGITIMATE OPERATION OF GETSPORTS ENTERPRISES LLC AND ITS GAMES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND IN THE EVENT THAT AN ATTEMPT BE MADE, WE RESERVE THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

Disclaimers: We are not responsible for any disruptions; injuries, losses of damages caused beyond the control of GetSports, and are not responsible for any printing or typographical errors in any materials associated with our site, or any subsidiary, affiliated company, or its vendors. WE ARE solely responsible for enacting, administering, and enforcing the rules, and maintaining the integrity of our site and its games. Neither our site nor its games are sponsored or endorsed by the National Football League or the NFL Players’ Association.

Legal Restrictions: Void where prohibited by law. Must be 18 or older to participate.

Scheduling: If for any reason, any of the leagues in which we run games for amends any portion of its schedule, GetSports reserves the right to determine contest winner(s) based on the principal of the situation.

Disputes/Appeals: Any disputes or appeals will be decided by GetSports and its interpretation of the rules. All rulings made by GetSports are final and binding. ANY DISPUTES MADE REGARDING A TRANSACTION FOLLOWING THE BEGINNING OF THE GAME IN QUESTION, WILL BE INVALID AND DISREGARDED. Players are solely responsible to verify that their transactions were made correctly.
